The "forth group" that Rabbenu Bachya is discussing now is the position a person should take as far as Enuman when it comes to his Mitzvot, Avarot, and way of life in serving H'ashem. This category is regarding things that effect him alone.
For something to be considered "service of GD or transgression" depend on three factors:
1. A conscious choice in ones mind and heart.
2. Full intention, knowledge and choice to carry out what he is about to do.
3. Putting into action with his body to accomplish what he has set out to do.
In these situation one must understand that H'shem has given us the ability and free will to either server him or rebel against him. That having been said, the CHOICE of wanting to serve Him or rebel against him will be cause for our reward or punishment. The actual ACT and whether we are able to succeed in accomplishing what we set out to is NOT in our hands. H'shem rather "made it dependent on external means that are sometimes present and at other times not"
